1. About anymrkt

anymrkt is a social commerce discovery platform operated by Black Code Enterprises LLC ("BCE," "we," "us"). anymrkt provides the platform to connect buyers and sellers.

2. Eligibility

You must be at least 18 years old to create an account or post listings. By using anymrkt you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Payments, Fees, and Payouts

anymrkt provides payment processing services for sellers through Stripe. By using our payment services, you agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement.

BCE charges a platform fee on each transaction, which is deducted from the payout to the seller. Fees vary by the seller's subscription plan. Payouts are transferred to the seller's connected bank account via Stripe.

4. Affiliate Links & Third-Party Platforms

Many links on anymrkt point to products on Amazon.com and other third-party platforms. anymrkt participates in the Amazon Associates Program and may earn a commission when you purchase through an affiliate link at no additional cost to you.

Prices, availability, and product details are controlled by third-party sellers and may change without notice. anymrkt does not guarantee the accuracy of any price, description, or availability shown. Always verify current pricing on the destination platform before purchasing.

When a creator adds an Amazon product link, anymrkt may append our Associates tag (shopanymrkt-20) to the URL if the creator has not provided their own affiliate tag. Creators who hold their own Amazon Associates account may use their own tag instead.

5. Demand Gauges

Demand gauges are expressions of interest only. Clicking "I'm interested" or submitting a demand response does not constitute a purchase, reservation, binding commitment, or contract. Creators use demand signals to validate ideas; they are not obligated to produce any product or service based on demand responses.

6. Prohibited Content & Items

The following are strictly prohibited on anymrkt. Violations result in immediate removal and account termination:

Illegal goods or services under U.S. federal or applicable state law
Controlled substances, drugs, drug paraphernalia, or prescription medications
Firearms, ammunition, explosives, or regulated weapons without verified licensing
Stolen property or goods obtained through fraud
Counterfeit, replica, or trademark-infringing goods
Adult content, sexually explicit material, or services of a sexual nature
Human trafficking, forced labor, or exploitation of any person
Hate speech, content targeting protected classes, or content inciting violence
Financial instruments, securities, investment schemes, or unlicensed financial services
Pyramid schemes, multi-level marketing (MLM) recruitment, or Ponzi structures
Gambling, sports betting, or lottery products in jurisdictions where prohibited
Hazardous, toxic, or radioactive materials
Live animals or endangered species products
Alcohol or tobacco sales to minors or without required licenses
Personal data, passwords, or account credentials
Malware, spyware, hacking tools, or unauthorized software
Content that impersonates any person, brand, or organization

7. User Responsibilities

By posting content on anymrkt, you represent and warrant that:

You own or have rights to all content you post.
Your listings are accurate, lawful, and do not infringe third-party rights.
You will not post prohibited items as defined in Section 6.
You will not use anymrkt to spam, harass, or deceive other users.
You are solely responsible for your off-platform transactions.
You will comply with all applicable laws, including Amazon Associates Program policies if applicable.

8. Content Removal & Account Termination

BCE reserves the right to remove any listing or content and suspend or terminate any account at our sole discretion, with or without notice, for any violation of these Terms or for any other reason that we determine threatens the safety, legality, or integrity of the platform.

We are not obligated to monitor all content but will act on valid reports. BCE operates under the protections of Section 230 of the Communications Decency Act as a platform, not a publisher, of user-generated content.

9. Intellectual Property

anymrkt and all platform content, design, and software are owned by Black Code Enterprises LLC and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

By posting content to anymrkt, you grant BCE a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that content solely in connection with operating the platform. You retain ownership of your content.

10. DMCA / Copyright Policy

If you believe content on anymrkt infringes your copyright, send a DMCA takedown notice to dmca@anymrkt.com including: (1) identification of the copyrighted work, (2) identification of the infringing material and its location on anymrkt, (3) your contact information, (4) a statement of good faith belief, and (5) a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.

11. Disclaimer of Warranties

anymrkt is provided "as is" and "as available" without warranties of any kind, express or implied. BCE does not warrant that the platform will be uninterrupted, error-free, or free of harmful components. BCE makes no warranties regarding the accuracy of listings, the quality of goods or services listed, or the trustworthiness of any user.

12. Limitation of Liability

To the maximum extent permitted by law, BCE and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses arising from:

Your use of or inability to use anymrkt
Any off-platform transaction between users
Unauthorized access to your account or data
Content posted by any user
Any third-party platform linked from anymrkt

In no event shall BCE's total liability to you exceed one hundred dollars ($100) or the amount you paid BCE in the six months preceding the claim, whichever is greater.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with proceedings conducted in Columbus, Ohio. You waive the right to a jury trial and the right to participate in a class action.

14. Changes to These Terms

BCE may update these Terms at any time. We will notify registered users by email or in-app notice. Continued use of anymrkt after changes take effect constitutes acceptance of the revised Terms.
